Chapter 359. Skateboards, Scooters and Roller Blades |
§ 359-6. Violations and penalties.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof:A.First offense. The skateboard, roller blades or scooter used in violation of this chapter shall be impounded by the Police Department of the Borough for a period not exceeding 90 days. In addition, any person shall, upon conviction, be sentenced to pay a fine of $50 and may be sentenced to incarceration for a period of up to 30 days. In the event said person is a minor, then, in that event, the parent, guardian, or other person having legal custody of the minor child shall be, upon conviction, sentenced to pay a fine of $50 and/or incarcerated up to a maximum period of 30 days, in addition to paying any and all costs associated with the prosecution.B.Second and/or subsequent offense. The skateboard, roller blades or scooter of any person violating the provisions of this chapter for the second and/or subsequent time shall be impounded by the Police Department of the Borough of Walnutport for a period not exceeding 180 days and said person shall, upon conviction, be sentenced to pay a fine of $100 and costs and/or be sentenced to incarceration for a period of up to 90 days. In the event said person is a minor, the skateboard, roller blades or scooter of said minor shall be impounded by the Police Department of the Borough for a period not exceeding 180 days and the parent, guardian, or other person having legal custody of said minor shall be, upon conviction, sentenced to pay a fine of $100 and costs and/or be incarcerated for a period not exceeding 90 days.
