§ 383-22. Drainage plan review.

  • A. 
    The municipality shall review the drainage plan, including the BMP Operations and Maintenance Plan, for consistency with the adopted Trout/Bertsch Creeks Watershed Stormwater Management Plan as embodied by this Part 1 and with any permits issued by DEP. The municipality shall also review the drainage plan against any additional storm drainage provisions contained in Chapter 395, Subdivision and Land Development, or Chapter 450, Zoning, of the Code of the Borough of Walnutport, as applicable.
    B. 
    The municipality shall notify the applicant in writing whether the drainage plan, including the BMP Operations and Maintenance Plan, is approved.
    C. 
    The municipality shall not approve any subdivision or land development [regulated activities, § 383-5B(1) and (2)] or building permit application [regulated activities § 383-5B(3) and (4)] if the drainage plan has been found to be inconsistent with the stormwater management plan.
    D. 
    The municipality may require an "as-built survey" of all stormwater BMPs and an explanation of any discrepancies with the drainage plan.
