§ 425-10. Weight limits on certain highways.

  • A. 
    It shall be unlawful for any person to operate any motor vehicle, trailer or semitrailer having a gross weight, including chassis, body and load, of more than 12,000 pounds, upon any of the following highways or portions thereof:
    (1) 
    All highways excluding Washington Street and Spruce Street. Provided: the aforesaid weight limit shall not apply to any motor vehicle or other vehicle, trailer or tractor-trailer combination making deliveries or picking up goods, wares, material or merchandise from any property located upon any such restricted zone, or any motor vehicle or other vehicle, or trailer or tractor-trailer combination for which a special permit to operate in any such restricted zone shall have been issued by the Chief of Police. Provided further: the provisions of this section shall not apply to the driving of vehicles hauling food or household goods, public utility vehicles, fire-fighting equipment, garbage and rubbish vehicles, or school and public transportation buses.
    (2) 
    Lehigh Gap Street.
    (a) 
    It shall be unlawful for any person to drive any motor vehicle, trailer or semitrailer having a gross weight, including chassis, body and load, of more than 12,000 pounds upon Lehigh Gap Street between SR-145 and SR-4022 (Mountain View Drive).
    (b) 
    Nothing in this chapter shall prohibit any person from driving an emergency vehicle on Lehigh Gap Street, or from driving a truck or other commercial vehicle making local deliveries to or pickups from premises located along Lehigh Gap Street.
    (c) 
    An official traffic-control device shall be erected in accordance with the terms of the Pennsylvania Motor Vehicle Code and applicable Pennsylvania code regulations.
    (d) 
    Any person who is fund guilty, by a competent court of law, of violating this Subsection A(2) shall be sentenced to pay a fine of not more than $500 and costs.
    B. 
    Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of $75 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight limit plus costs of prosecution.
